Why is freight forwarder's liability insurance important?

For companies in the transportation and logistics sector, freight forwarder's liability insurance is a key component of operational insurance. It protects against financial consequences if damage occurs within the scope of transportation contracts - for example due to damaged goods, delayed deliveries or other incidents in day-to-day business. Without this insurance cover, claims for damages can quickly reach high sums and jeopardize the economic existence of the company.

What are typically excluded hazards?

Not all risks are covered by forwarding liability insurance. As a rule, claims caused by intentional or grossly negligent violations of public law regulations - such as transportation without the necessary permits - are excluded. Damage caused by war, civil war, terrorism, strikes or similar events is also not covered. Delays in delivery agreed under unreasonable conditions and official orders such as confiscations are also not covered by the insurance. Furthermore, breaches of sanction regulations are excluded from the scope of cover.

How is the insurance contract concluded?

The process begins with a risk analysis: the carrier fills out a corresponding questionnaire and submits it to LUTZ ASSEKURANZ after reading and accepting the insurance conditions. The insurance policy is then issued on the basis of the agreed conditions and a premium invoice is sent to the policyholder.

Only when the premium has been paid in full and on time does the insurance cover under the concluded insurance contract come into force.

Are there any special, important obligations?

Yes, certain obligations apply to the insurance cover, which must be strictly observed by the policyholder. These include, in particular, internal company precautions such as the careful selection and commissioning of truck sub-carriers, the installation of suitable security measures to protect the goods - such as anti-theft devices on the vehicle - as well as the selection, instruction and monitoring of employees. One example of this is the clear instruction to drivers to only take breaks in guarded parking lots. Compliance with these requirements is crucial for maintaining insurance cover.

Which "special" goods have sublimits or are excluded?

Certain groups of goods are subject to special restrictions in forwarding liability insurance. For example, sensitive sublimits are common for works of art, while other goods such as cars, live animals or heavy goods with an individual weight of over 30 tons are often completely excluded from insurance cover.

In such cases, an individual agreement with the insurer is required to ensure the desired insurance cover.

What is CMR insurance?

CMR insurance is a special liability insurance for cross-border transportation in international road freight traffic between CMR states. It covers liability claims for damage to goods and certain financial losses that may arise under the CMR Convention. For freight forwarders and carriers, it is a key component of cover for international transportation.
